Abstract: The essay is focused on the traumatic truckers’ blockade which affected Brazil between 21 and 31 May 2018, and its direct repercussions on the regulatory agency’s behavior. Significant part of the government bargaining involved the participation of the National Agency of Terrestrial Transport (ANTT), which was responsible for the regulation of the minimal pricing policy for freight transportation throughout the country. The highly unstable regulations adopted by the Agency in just a few days have revealed the fragile autonomy of the entity, in order to uncover a “de facto quasi-regulatory” performance. The same perspective seems applicable to other Brazilian agencies, when we analyze the aggressive institutional pattern adopted by the Presidency, the Ministry and the Judiciary on regulatory issues. In the end, there is a short postscript on the avoidable recent tragedy of Brumadinho.
Resumo: Centra-se o artigo no traumático bloqueio dos caminhoneiros que afetou o Brasil entre 21 e 31 de maio de 2018, juntamente com suas repercussões diretas no comportamento da respectiva agência regulatória. Parte significativa das tratativas negociais governamentais envolveram a participação da Agência Nacional de Transporte Terrestre (ANTT), a qual é responsável pela regulamentação da política de preço mínimo para o frete aplicável em todo o país. Consoante foi possível verificar, as regulações altamente instáveis adotadas pela Agência em um curto tempo revelaram a autonomia frágil da Entidade, de modo a revelar uma performance “quase regulatória de fato”. A mesma perspectiva aparenta ser aplicável a outras agências reguladoras brasileiras, quando analisamos o padrão institucionalmente agressivo adotado pela Presidência da República, pelo Ministério de Estado e pelo Judiciário no tocante a questões regulatórias. Ao final, foi acrescido um pequeno pós-escrito relacionado à evitável recente tragédia de Brumadinho.
